These Terms of Service (the "Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the Ulsav website and any other related mobile or software applications under the brand name "Ulsav" (collectively "Platform").
Please read these Terms carefully. By accessing or using the Platform, you are agreeing to these Terms and concluding a legally binding contract with Hexinox Innovations Private Limited and/or its affiliates (“Hexinox”/“We”/“Us”/“Our”). You may not use the Platform and/or its Services if you do not accept the Terms or are unable to be bound by the Terms.
Your use/access of the Platform shall be governed by these Terms and the Privacy Policy as available on the Platform (“Privacy Policy”).
These Terms may be updated from time to time without notice. It is therefore recommended that you review these Terms, as available on the Platform, each time you access and/or use the Platform. In the event there is any conflict or inconsistency between these Terms and any other terms and conditions that appear on the Platform, these Terms will prevail.
By accessing or using the Platform you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Platform.
Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 are not eligible to use/access the Platform. However, if you are a minor, i.e. under the age of 18 years, you may use/access the Platform under the supervision of an adult parent or legal guardian who is "competent to contract" and agrees to be bound by these Terms.
If you are using the Platform on behalf of any person / entity, you represent and warrant that you are authorized to accept these Terms on behalf of such person / entity. Further, you and such person / entity agree to be jointly, severally liable and indemnify us for violations of these Terms.
You agree to use the Services only in compliance with these Terms and applicable laws, and in a manner that does not violate our legal rights or those of any third party(ies).
Events listed on Ulsav are organized by event Organizers, not us. We are a third party service providing the technology for managing events, and are not responsible or liable:
If you have an issue or question regarding any of the above, you should contact the event Organizer. Event Organizers have full control over their events, and it is their responsibility to inform you of any relevant terms or policies that apply to your use of the Platform outside of these Terms, as well as to respond to and resolve any disputes that you may have regarding their events.
If you are purchasing tickets from anywhere outside of Platform, including through any authorized promoters, it shall be completely your own responsibility to verify the genuineness of the source and authenticity of the ticket issued to you.
Ulsav does not directly conduct any events, and is only acts as a technology enabler and intermediary between the event organizers and the participants. As such, all refunds and cancellations are subject to the policies of the event organizers.
We require Event Organizers to publish their Refund policy on their event portal, and this would be shown to users before they complete their purchase, and could be accessed also from the Site footer. We request you to carefully read through the official Refund policy of the Event Organizer as published on the portal before registering and making any payment towards the event. If the refund policy, is missing or the one published on the event Site is incomplete or unsatisfactory, we request you to contact the Event Organizer directly to clarify the same before making any payment towards the event. The official Refund policy of the Event Organizer shall be the only policy applicable to the event, and Ulsav shall not be responsible or liable for any refunds or cancellations.
Event Organizer is responsible to communicate their refund policy to Participants, and to issue refunds to Participants via Payment Gateway or through other payment method used to collect payments.
All communications or disputes regarding refunds are between Event Organizers and the registered Participants, and Ulsav will not be responsible or liable for refunds, errors in issuing refunds, or lack of refunds.
Ulsav reserves the right to deny entry and refunds for tickets purchased outside of Ulsav Platform. Any decisions taken by the event Organiser and Ulsav will be final and binding in this regard.
If you find that you have been issued fake tickets not authorized by us, then you may be a victim of fraud, for which you may consider filing appropriate police complaints/first information report at the nearest police station having jurisdiction over the area of your residence. We bear no responsibility or liability, under any law or circumstances, for such frauds committed by unauthorized third parties.
You are consenting to receive transactional and promotional messages, or notifications, either as generated by the Platform, from Ulsav or otherwise from the Event Organizer of any event you have registered through the Platform. You will be receiving notifications as SMS, Email, WhatsApp, or Voice Call.
We provide all Users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from Us on behalf of our partners, and from Us in general, after setting up an account.

For opting out of receiving any transactional and promotional messages or notifications on your whatsapp or as SMS, please reach out to us at [email protected] and we will assist you.
You must not use the Platform in any unlawful or fraudulent manner, or in a way that could damage or compromise our systems or security. And you must not access the Platform by any means other than our publicly supported interfaces.
If you import people's data into the Platform, such as names, emails, phone numbers etc., you must have their explicit consent to import them and communicate to them. Violation of this policy will result in suspension of your account.
Your access to the Platform may occasionally be suspended or restricted to allow for repairs, maintenance, or due to the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction, and attempt to communicate any such suspension or restriction to you in advance.
You agree that Ulsav will not be liable for any losses that may be incurred by you if for any reason all or part of the Platform is unavailable at any time or for any period for use.
If any User(s) submits suggestions, ideas, comments, or questions containing product feedback about the Ulsav or any of the Services, either through the Ulsav's official website or otherwise (“Feedback”), then such User(s) grants Ulsav and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use (and full right to sublicense), reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, and display such Feedback in any form. Users shall have no intellectual property right in the Platform as a result of Ulsav's incorporation of Feedback into the Platform.
Our Platform may contain links to third-party websites or services that are not owned or controlled by Ulsav.
We have no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
If you find any link on our Platform that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links, but we are not obligated to or so or to respond to you directly.
You agree to indemnify and hold harmless Ulsav and its successors and assigns and all of their respective officers, directors, subsidiaries, affiliates, agents and employees, from any claims, liability, judgments, awards, losses, obligations, costs, expenses or fees (including reasonable attorneys' fees), demands, or actions made by any third party or penalty imposed due to or arising out of your breach of the Agreement or any document incorporated by reference, any claim that content provided by you caused damage or loss to a third party, or your violation of any law, rules, regulations or the rights of a third party.
You hereby expressly release Ulsav and any of its officers and representatives from any cost, damage, liability, or other consequence of any actions/inactions of any third-party vendors or service providers and specifically waive any claims or demands that you may have in this behalf against Ulsav under any statute, contract or otherwise.
These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Kochi, Kerala.
Modification, Amendment or Termination: Ulsav may, in its sole discretion, modify or revise the Agreement and policies at any time, and you agree to be bound by such modifications or revisions. Your continued use of the Site post any modification of the Agreement shall be taken as your consent and acceptance to such modifications. Nothing in the Agreement shall be deemed to confer any third-party rights or benefits. You are advised to check our terms and conditions as published and updated at https://ulsav.com/terms, frequently to see recent changes and to keep yourself updated with the most recent updates.
Force Majeure: Ulsav shall not be liable for failure to perform, or the delay in performance of, any of its obligations if, and to the extent that, such failure or delay is caused by events substantially beyond its control, including but not limited to acts of God, acts of the public enemy or governmental body in its sovereign or contractual capacity, war, terrorism, floods, fire, strikes, epidemics, civil unrest or riots, power outage, and/or unusually severe weather.
If any part of the Agreement is found to be unlawful, void or unenforceable, that part of the Agreement will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
Headings are for reference purpose only and in no way define, limit, construe or describe the scope or extent of such section.
Our failure to act with respect to any breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
We do not guarantee continuous, uninterrupted, or secure access to our Sites, and operation of the Sites may be interfered by numerous factors outside our control.
